Great article. There's a lot of good data here, though I did want to let you know something - I am running Redhat with the up-to-date beta of Firefox, and the design of your blog is kind of bizarre for me. I can read the articles, but the navigation doesn't work so good.

If American Needle wins the case, does that mean anything for other licensing agreements, such as Madden licensure? I always thought it was a major blow to quality football videogaming when EA purchased exclusive NFL licensing rights. A fella can dream, can't he?

My probably unsupportable position is the the American Needle vs the NFL is exempt from the Sherman anti-trust act by way of the sports broadcasting act.

Chris-

What then is your personal position on the NFL? Is it engaged in the restraint of trade or commerce? Or did competitors such as the USFL, XFL, whatever the league this year is called, fail because they were inefficient firms and the NFL was the efficient firm?
Was the NFL created as an entity to restrain trade? And does the Sherman Act section I apply? So more United States v. Yellow Cab Co., 332 U. S. 218, or Copperweld v. Independence Tube, 467 U.S. 752 (1984)
Anyway I agree with your analysis of the positives and negatives for the NFL, that is lots of upside and virtually no downside (What you would call in the card game Omaha "freerolling").
